1. Acceptance of these Terms
These Terms of Service (“Terms”) form a binding agreement between you and Byeoo, sole proprietorship (“Byeoo”, “we”, “us”) governing your use of the Byeoo application, website and related services (the “Service”). By installing, accessing or using the Service you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy, the Navigation Safety Disclaimer, the AI Recommendation Disclaimer, the Accessibility Disclaimer and the Health & Environmental Disclaimer. If you do not agree, do not use the Service.
2. Description of the Service
Byeoo is a human-centered adaptive navigation platform that suggests routes for walking, cycling, wheelchair use, strollers, families, seniors, dog walks and other mobility profiles. Suggestions are produced from a combination of GPS, third-party maps, elevation models, weather data, terrain estimates, accessibility data, environmental conditions and AI-assisted scoring. The Service is provided for general guidance only.
3. Guidance only — no guarantee of safety or accuracy
Byeoo provides recommendations and informational guidance only. We do not guarantee that any route is safe, legal, accessible, comfortable, passable, fast, healthy, or suitable for you. In particular, we make no warranty regarding:
- route safety, legality or suitability for your mobility profile;
- the accuracy or completeness of map, terrain or accessibility data;
- real-time conditions such as weather, air quality, surface, traffic, crowding, construction, closures or hazards;
- GPS positioning, which can be inaccurate or unavailable indoors, in urban canyons, tunnels and similar environments;
- third-party data, APIs or map providers whose content we resurface;
- uninterrupted, error-free or secure operation of the Service.
4. User responsibility & assumption of risk
You are solely and fully responsible for your decisions, conduct and safety while using the Service. You knowingly and voluntarily assume all risks arising from your use of the Service, including but not limited to: incorrect or outdated navigation instructions; inaccurate map, accessibility, wheelchair, stroller, elevation, slope, stair, surface, terrain, weather or air-quality data; mistaken turn-by-turn guidance; missed turns; ambiguous left/right or compass directions; delays; missed appointments, flights or transport; financial loss; falls, slips, collisions, injuries or property damage; getting lost; exposure to traffic, animals, weather, pollution or hostile environments; and any consequence of acting on a Byeoo recommendation. You agree to:
- obey all applicable traffic laws, signs and signals;
- continuously observe your surroundings and not rely on the Service to detect hazards;
- independently assess any route, terrain, weather and accessibility condition;
- not follow any navigation instruction that appears unsafe or unlawful;
- not use the Service while operating a vehicle in a manner that distracts you from driving or that violates local law;
- ensure the Service is appropriate for any third party (such as a child in a stroller, a person with a disability or a dog) under your care, and accept full responsibility for that third party's safety;
- verify on-site any ramp, elevator, curb cut, stair-free path, surface or other accessibility feature before relying on it;
- carry an independent backup means of orientation (paper map, alternative app or local knowledge) for any trip where getting lost would be unsafe.
4a. No reliance for time-sensitive or safety-critical activities
You acknowledge that the Service must not be used as the sole basis for any time-sensitive, safety-critical, medical, emergency, professional, commercial or financial decision. Byeoo is not suitable for, and is not designed for, professional driving, emergency response, aviation, marine navigation, off-road expeditions, search-and-rescue, mountaineering, time-critical logistics, or any activity where an error in routing, ETA, accessibility or terrain information could cause harm or loss.
5. Eligibility & accounts
You must be at least 16 years old, or the minimum age permitted in your jurisdiction, to use the Service. If you create an account, you are responsible for keeping your credentials secure and for activity on your account.
6. License
Subject to these Terms, Byeoo grants you a personal, non-exclusive, non-transferable, revocable license to use the Service for non-commercial personal navigation. You may not reverse engineer, scrape, resell or build a competing service from the Service or its data.
7. Third-party data and services
The Service relies on third-party providers (including mapping, routing, geocoding, elevation, weather and analytics providers). Their data is provided “as is” and is subject to their own terms. We are not responsible for third-party content or downtime.
8. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, reliability, availability and non-infringement. Without limiting the foregoing, Byeoo expressly disclaims any warranty that: (a) any route, instruction or ETA is correct, safe, legal, accessible or passable; (b) any wheelchair, stroller, senior, family or dog-walk route is suitable for your equipment, ability or companions; (c) any elevation, slope, surface, stair, ramp, curb-cut, elevator, width or terrain attribute matches real-world conditions; (d) any weather, temperature, UV, air-quality or environmental reading is current or accurate; (e) the Service will be uninterrupted, timely, secure or error-free; or (f) third-party map, routing, geocoding, elevation, weather or accessibility data is correct or complete.
9. Limitation of liability
To the maximum extent permitted by law, in no event shall Byeoo, its affiliates, founders, directors, officers, employees, agents, contractors, suppliers or licensors be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, business, contracts, opportunities, data, goodwill, savings, anticipated benefits, personal injury, illness, death, emotional distress, property damage or other tangible or intangible losses, arising out of or related to: (i) your use of, or inability to use, the Service; (ii) any route, instruction, ETA, accessibility, terrain, elevation or weather information surfaced by the Service; (iii) any delay, detour, missed appointment, missed transport or financial loss; (iv) any fall, slip, accident, collision, injury or property damage occurring during or after use of the Service; (v) reliance on third-party data, APIs or providers; or (vi) any temporary route condition, construction, closure or hazard — even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose. Where liability cannot be excluded by law, our aggregate liability to you for all claims arising out of or related to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) EUR 50. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable mandatory law (including, where applicable, EU consumer protection rules).
9a. Force majeure
Byeoo is not liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, government action, epidemics, strikes, extreme weather, power or network outages, third-party service failures, satellite or GPS disruption, or denial-of-service attacks.
10. Indemnification
You agree to indemnify and hold harmless Byeoo from any claim, loss or expense (including reasonable legal fees) arising from your misuse of the Service, breach of these Terms or violation of any law or third-party right.
11. Changes to the Service and Terms
We may modify or discontinue any part of the Service at any time. We may update these Terms from time to time; material changes will be notified inside the app and trigger a new acceptance flow.
12. Governing law & jurisdiction
These Terms are governed by the laws of the operator’s jurisdiction within European Union, without regard to conflict-of-law principles. Mandatory consumer rights in your country of residence remain unaffected.
13. Translations
Translations are provided for convenience and accessibility. Unless mandatory consumer law requires otherwise, the English version controls if a translation differs from it. Nothing in this clause limits rights that cannot legally be waived in your country.
